Terms & Conditions

By accessing or using the Mabrooq platform — including our website at www.mabrooq.com and any associated mobile applications (collectively, the "Platform") — you agree to be bound by these Terms and Conditions (the "Terms") and our Privacy Policy, which are incorporated by reference.

If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Mabrooq Events LLC ("Mabrooq", "we", "us", or "our"), a company registered in the United Arab Emirates.

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after the effective date of any changes constitutes your acceptance of the revised Terms.

Mabrooq is a two-sided marketplace that connects individuals and businesses ("Clients") with independent event creators, vendors, and artisans ("Creators" or "Sellers") offering event-related services including, but not limited to: decor, cakes, gifts, mehndi artistry, makeup, photography, and entertainment.

Mabrooq acts solely as an intermediary marketplace facilitator. We are not a party to the service agreement formed between Clients and Creators. We do not own, operate, or control the services offered by Creators on the Platform.

• Mabrooq is not responsible for the quality, legality, or suitability of services offered by Creators.
• Mabrooq is not responsible for the accuracy of Creator listings, photos, or descriptions.
• Mabrooq does not guarantee the availability of any Creator or service.
• The Platform is provided "as is" and may be subject to downtime, updates, or maintenance.

To create an account and use certain Platform features, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction.
• Provide accurate, current, and complete information during registration.
• Maintain the security and confidentiality of your account credentials.
• Notify Mabrooq immediately of any suspected unauthorised access to your account.
• Not create more than one personal account without our express written consent.

You are solely responsible for all activity conducted through your account. Mabrooq reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or the integrity of the Platform.

When a Client submits an enquiry and a Creator accepts, a service agreement is formed directly between the Client and the Creator. Mabrooq facilitates this connection but is not a party to the agreement.

Mabrooq reserves the right to:

• Cancel or suspend bookings if either party is found to be in violation of these Terms.
• Mediate disputes between Clients and Creators at its sole discretion.
• Modify or discontinue Platform features used for bookings at any time.

All payments on the Platform are processed through Mabrooq's secure payment infrastructure. By making a payment, you authorise Mabrooq to charge the applicable amount to your selected payment method.

Key payment terms:

• A platform service fee may be charged to Clients on each transaction, displayed transparently at checkout.
• Creators pay a commission on each completed booking as agreed during onboarding.
• Payments are held in escrow by Mabrooq until service completion is confirmed.
• Creator payouts are processed within 3–5 business days of confirmed service delivery.
• All prices on the Platform are displayed in UAE Dirhams (AED) unless otherwise stated.
• Mabrooq is not responsible for foreign transaction fees charged by your bank or card issuer.

Refunds:Refund eligibility is determined by the Creator's individual cancellation policy. If a Creator cancels or materially fails to deliver the agreed service, Mabrooq will review the case and may issue a full or partial refund at its discretion.

You agree not to use the Platform to:

• Violate any applicable local, national, or international law or regulation.
• Post false, misleading, or fraudulent content including fake reviews.
• Circumvent the Platform by conducting transactions with Creators outside of Mabrooq to avoid fees.
• Harass, threaten, intimidate, or harm other users.
• Upload or transmit viruses, malware, or any other malicious code.
• Scrape, crawl, or systematically download data from the Platform without written permission.
• Impersonate another person or entity, or misrepresent your affiliation.
• Engage in any conduct that could damage, disable, or impair the Platform.
• Use the Platform for any illegal or unauthorised commercial purpose.
• Share, sell, or transfer your account credentials to any third party.

Violation of this section may result in immediate account suspension, termination, and legal action where appropriate.

All content on the Platform — including the Mabrooq name, logo, design, text, graphics, software, and code — is the exclusive intellectual property of Mabrooq Events LLC or its licensors and is protected by UAE and international copyright, trademark, and other intellectual property laws.

Your Content: By uploading photos, reviews, portfolio items, or other content to the Platform, you grant Mabrooq a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform.

You represent and warrant that you own or have the necessary rights to all content you submit, and that such content does not infringe the intellectual property rights of any third party.

You may not reproduce, distribute, modify, or create derivative works of any Mabrooq content without express written permission.

To the maximum extent permitted by applicable law, Mabrooq and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Platform.

This includes, without limitation:

• Loss of profits, revenue, data, or goodwill.
• The conduct or content of any Creator or Client.
• Any service failure, delay, or cancellation by a Creator.
• Unauthorised access to or alteration of your data.
• Any bugs, errors, or interruptions in Platform availability.

In no event shall Mabrooq's total aggregate liability to you exceed the greater of (a) the total fees paid by you through the Platform in the 12 months preceding the claim, or (b) AED 1,000.

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

You agree to attempt to resolve any dispute with Mabrooq informally by contacting us at legal@mabrooq.com before initiating any formal legal proceedings.
